FinSA Advisor Register FAQs updated
The FAQs on the registration obligation in the FinSA Advisor Register have been comprehensively revised.
Who is required to register in the FinSA Advisor Register? This question continues to concern many financial service providers and client advisers. To facilitate the practical assessment of the registration obligation, the Advisor Register has revised its FAQs and aligned them with current regulatory developments.
The updated version takes recent regulatory developments into account and addresses additional questions that are becoming increasingly relevant in practice.
Key Changes at a Glance
-
Crypto Assets
The FAQs now explain under which conditions crypto assets qualify as financial instruments within the meaning of the Swiss Financial Services Act (FinSA). Where this is the case, a registration obligation in the FinSA Advisor Register may arise. As digital assets are increasingly becoming part of investment advisory services, this clarification provides greater legal certainty for financial service providers.
-
BFSA: Special Rules for Financial Service Providers from the United Kingdom
The FAQs now also take into account the Berne Financial Services Agreement (BFSA) between Switzerland and the United Kingdom. Under certain conditions, client advisers of UK financial service providers may be exempt from the registration requirement in the Swiss Advisor Register. The FAQs explain the relevant conditions in detail.
-
Finfluencers and Registration Requirements
A new FAQ has also been added regarding the registration obligation for finfluencers. Individuals who provide investment recommendations or other financial services through social media may, under certain circumstances, qualify as client advisers and therefore be subject to the registration requirement under FinSA. This addition reflects the growing importance of digital communication channels within the financial sector.

Further Clarifications
In addition, legal references have been updated, language has been refined, individual explanations have been clarified, and the practical usability of the FAQs has been improved.
These updates are intended to help financial service providers assess their registration obligations more easily and reliably in the future.
Why Are the Updated FAQs Important?
The revised FAQs help financial service providers and client advisors better understand regulatory requirements and reduce uncertainty regarding registration obligations. In particular, the new guidance on crypto assets, finfluencers and the BFSA reflects current developments in the financial market and increases transparency.

Note: The FAQs were prepared by the Swiss Advisor Register and acknowledged by FINMA. They serve as practical guidance only and do not constitute legal advice. Whether a registration obligation exists must always be assessed on a case-by-case basis. Where uncertainty exists, obtaining legal advice is recommended.
